Terms & Conditions of Service

1. Introduction

By requesting and accepting services from Home Advantage Plumbing Services LLC ("Company," "we," "us," or "our"), you ("Customer," "you," or "your") agree to be bound by these Terms & Conditions of Service. Please read them carefully. If you do not agree with these terms, do not engage our services. These terms supersede any prior agreements or understandings.

2. Description of Services

Home Advantage Plumbing Services LLC provides plumbing services including, but not limited to: installation, repair, maintenance, and replacement of plumbing systems and fixtures. All work is performed by licensed and/or experienced plumbers in accordance with Pennsylvania plumbing codes and industry standards.

3. Licensing & Insurance

Home Advantage Plumbing Services LLC is a licensed plumbing contractor in Pennsylvania. We maintain liability insurance to protect both our business and our customers. Our plumbers are trained professionals and follow all applicable local and state plumbing codes.

4. Estimates & Change Orders

4.1 Non-Binding Estimates

All estimates provided are non-binding good-faith approximations of anticipated costs. The estimate is based on initial visual inspection only and does not constitute a guarantee of final price.

4.2 Scope Discovery

Once the system is opened, inspected, or tested, additional issues may be discovered. If less work is required than estimated, the final cost may be lower. If more work is needed, we will issue a change order or notify you before proceeding with additional charges (except in emergency situations where immediate action is required to prevent damage).

4.3 Final Invoice

The final invoice reflects the true cost of work, labor, and materials actually provided. Approval of an estimate does not guarantee that every line item will be completed or that the final cost will match the estimate.

4.4 Sewer Lateral Work

Sewer lateral repair and excavation work is invoiced by the day and does not follow standard estimate pricing. A day rate will be provided separately for such work.

5. Payment Terms

5.1 Due Upon Completion

Payment is due in full upon completion of work. We accept cash, checks, and major credit cards.

5.2 Deposits

We reserve the right to require a deposit (typically 30-50% of estimated cost) for large projects or emergency calls.

5.3 Late Payment

Payment not received within 24 hours of service completion may be subject to a $35 late fee. If payment remains outstanding after 7 days, an additional $35 late fee will be assessed weekly (up to a maximum of 4 weeks). After 30 days of non-payment, we reserve the right to pursue legal action, collections, or report the debt to credit bureaus. The customer is responsible for all collection costs, attorney fees, and court costs.

5.4 Interest on Past-Due Accounts

We reserve the right to charge 1.5% monthly interest on past-due balances or the maximum rate permitted by Pennsylvania law, whichever is lower.

6. Warranty

6.1 Company-Supplied Materials and Labor

Home Advantage Plumbing Services LLC provides a warranty on all labor and materials supplied by us. Standard warranty periods are as follows:

• Fixtures & Appliances: Manufacturer's warranty (typically 1-5 years)
• Piping & Fittings: 1 year from date of installation
• Labor: 1 year from date of completion (defects in workmanship)

6.2 Customer-Supplied Materials

Materials provided by the customer carry no warranty from us and no liability for damages caused to the home in the event of failure or malfunction.

6.3 Warranty Claims

Warranty claims must be reported within 30 days of discovery. Claims are limited to repair or replacement of the defective materials or labor, at our discretion.

7. Old Piping & Fixtures

7.1 Customer Responsibility

It is the customer's responsibility to disclose the existence of old, deteriorated, or aging pipes and fixtures prior to engaging our services. "Old piping and fixtures" includes any materials installed before our service or those showing signs of significant wear, age, corrosion, or damage.

7.2 No Liability for Old Systems

Home Advantage Plumbing Services LLC shall not be held responsible for issues, damages, or liabilities arising from old pipes and fixtures, including but not limited to: hidden damage, burst pipes, corrosion, leaks, code violations, or performance problems.

7.3 Consequences of Non-Disclosure

Failure to disclose old piping or fixtures may result in additional charges or service limitations.

7.4 Release of Liability

By accepting our services, you acknowledge, understand, and agree to release us from any and all claims, damages, or liabilities related to old pipes and fixtures.

8. Limitation of Liability

8.1 Liability Cap

Our total liability for any claim arising from our services is limited to the amount paid for the specific service in question, not to exceed the total invoice amount.

8.2 Exclusions

We are not liable for:

• Indirect, incidental, consequential, special, or punitive damages
• Water damage or water intrusion resulting from plumbing repair or installation
• Lost profits, business interruption, or loss of use
• Damage caused by natural disasters, weather, accidents, or events beyond our control
• Issues resulting from failure of property owners to obtain required permits or inspections

9. Code Compliance & Permits

9.1 Our Compliance

Home Advantage Plumbing Services LLC complies with all applicable local and state plumbing codes and will obtain any necessary permits on your behalf for work performed.

9.2 Customer Responsibility

The customer is responsible for ensuring that the property is properly inspected by local authorities and for paying any required inspection fees. We are not responsible for fines, penalties, or violations resulting from customer failure to obtain required permits or arrange inspections.

10. Cancellation & Rescheduling

10.1 Advance Notice

If you need to cancel or reschedule an appointment, please notify us at least 24 hours in advance.

10.2 Cancellation Fee

Failure to cancel at least 24 hours in advance may result in a $49 cancellation fee, which will be charged to you.

11. Customer Responsibilities

11.1 Access & Safety

You agree to provide safe, unobstructed access to the work areas. You are responsible for the safety of our workers and for disclosing any hazards, including but not limited to: aggressive animals, hazardous materials, electrical hazards, or gas leaks.

11.2 Utilities

Ensure that utilities (water, gas, electricity) are turned on as needed for our work. You are responsible for payment of any utility-related issues resulting from work performed.

11.3 Full Disclosure

Disclose all known issues with your plumbing system, including age of pipes, previous problems, or repairs performed by others.

12. Dispute Resolution & Arbitration

12.1 Good Faith Negotiation

Before pursuing legal action, both parties agree to attempt to resolve disputes through good faith negotiation.

12.2 Binding Arbitration

Any dispute not resolved through negotiation will be resolved through binding arbitration rather than court proceedings. Arbitration will be conducted in Montgomery County, Pennsylvania, under rules established by JAMS or AAA. Each party is responsible for its own legal fees unless arbitration rules or applicable law provide otherwise.

13. Confidentiality

We respect your privacy and will not disclose personal information without your consent, except as required by law or legal process.

14. Termination of Services

We reserve the right to refuse or terminate services at any time if the customer violates any portion of this agreement, behaves inappropriately toward our staff, or poses a safety risk.

15. Amendments to Terms

Home Advantage Plumbing Services LLC reserves the right to amend these terms with 30 days' written notice to customers. Continued use of our services after notice of amendment constitutes your acceptance of the amended terms.

16. Governing Law

This agreement is governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles. Jurisdiction and venue for any legal proceedings not covered by arbitration will be in the state or federal courts located in Montgomery County, Pennsylvania.
